Purpose
These terms govern access to and use of the Maki service: the website, the mobile app and the features attached to them.
Using Maki, with or without an account, means accepting these terms.
The service
Maki lists African restaurants and grocers, lets you order from them, and hosts recipes published by the community.
Browsing venues, products and recipes works without an account. Ordering, saving a favourite or publishing content requires one.
Your account
- Accounts are open to people aged 15 and over.
- The information you provide must be accurate and kept up to date.
- Your account is personal: you are responsible for keeping your credentials confidential and for what is done from your account.
- You can delete your account at any time from the app.
Maki's role
Maki is a technical intermediary. The sales contract is formed directly between you and the partner merchant preparing your order.
Descriptions, prices, availability, opening hours and product composition come from the merchants, who are responsible for them. Maki visits every venue before it goes live, but does not take the merchant's place.
Allergens and dietary requirements are the merchant's responsibility: if you have an allergy, contact them before ordering.
Orders and payment
- Prices are shown including tax; any delivery fee is shown before you confirm your basket.
- Payment is processed by Stripe. Maki stores no card details.
- An order becomes final once the merchant accepts it; a summary is sent to you.
- Before acceptance, you can cancel from the app. Once preparation has started, the order can no longer be cancelled.
- Perishable food is not covered by the right of withdrawal, under article L221-28 of the French Consumer Code.
Delivery and pickup
Depending on the venue, your order is delivered to the address you give or picked up in person. Displayed times are estimates: they depend on preparation and traffic.
An address outside the delivery zone automatically switches to pickup.
Content published by members
Reviews and recipes are published under their authors' responsibility. By publishing them, you grant Maki a free, non-exclusive licence to display, translate and lay them out within the service, for as long as they remain published.
Any content may be removed by moderation, with its author informed. Repeated removals can lead to the account being suspended.
- A review must be based on a real experience.
- Unlawful, defamatory, hateful, discriminatory or misleading content is prohibited.
- Advertising content and fake reviews, whether written or commissioned, are prohibited.
- You must hold the rights to the photos you publish.
Liability
Maki makes reasonable efforts to keep the service available and accurate, without guaranteeing uninterrupted service: outages for maintenance or incidents remain possible.
Maki is not responsible for the quality, compliance or food safety of products sold by partner merchants, nor for content published by members.
Suspension and termination
You can delete your account at any time from the app.
Maki may suspend or close an account that breaches these terms, after informing its holder, except in an emergency or where the law requires otherwise.
Changes to these terms
These terms may change. Users are informed in the app; using the service after a change takes effect means accepting it.
Governing law and disputes
These terms are governed by French law.
If a dispute arises, we look for an amicable solution first: write to smoothandesign@gmail.com. Failing agreement, you may refer the matter free of charge to a consumer mediator before taking any legal action.
If no amicable solution is found, the French courts have jurisdiction.
